Claims

As part of Trade Mark Protect, you have a choice of provider dependant on your circumstances: 

  • If you filed yourself:

    We can appoint an Attorney to assist in your dispute

  • If you filed through an attorney:

    You can use your own attorney

If you opt to use your own attorney there is an applicable excess, you should refer to your policy schedule to confirm this amount. However if your attorney is an Approved Provider, then this excess does not apply. Your attorney can contact us to become an approved provider at any time.

What is an Approved Provider?

An Approved Provider is simply an attorney who has entered into an agreement with us around the management of claims to ensure that the claim process is clear and as simple as possible.

Do I have to use an Approved Provider?

No, if you purchased through an attorney and nominate them when purchasing the policy, you will be able to use them as your legal provider.

What should I do if I need to make a claim?

If you think you have a claim under one of our policies you should Contact Us as soon as possible with further information. You must follow your policy’s terms and conditions – a delay in notifying your insurer of a claim can affect your coverage.

What information do I need to collect?

You should provide all information you consider relevant to the dispute. If you are unsure, we will be able to help you.

Fraudulent Claims

If any claim be in any respect fraudulent or if any fraudulent means or devices be used by the Assured or anyone acting on the Assured's behalf to obtain any benefit under this Policy, or if any loss hereunder be occasioned by the wilful act or with the connivance of the Assured, the Underwriters, without prejudice to any other right(s) they might have under this Policy, shall be entitled to refuse to pay such claim.
